If you put fetish club and BDSM studio in the same search, you usually want a door decision: a night among guests, or an hour you book. The words overlap. The contract at the door does not.

Fetish, in the narrow sense, is arousal through a material, a garment, an object or a situation. BDSM groups bondage, discipline, dominance and submission, sadism and masochism. A club night can sell the first as a look. A studio sells the second as a negotiated hour. Plenty of houses mix both. The ticket still says which evening you bought.

Ticket or appointment

A fetish club typically sells a night. There is a calendar, a door, often a dress code, often a cover charge. You are a guest among guests. Whether there is a dancefloor, a pool or a play area is on the event page, not in the word fetish.

A BDSM studio typically sells a session. You write to a specific person, agree a time, often pay a deposit. Walk-in custom is often not wanted. The Initiative Kundschaft pro Sexarbeit describes the usual pattern: enquiry, deposit, a short talk at the door, the fee, a shower, then the hour. Aftercare is part of that pattern, not decoration.

A third model exists: you rent a play room without a dominatrix. That is a room hire, not a club night and not a session. Fetish Lofts in Hamburg, listed here under BDSM studios, sells that hire on its site. Do not treat the category as the contract.

Guest, or the person who paid for the hour

In the club you share the house with other guests. Looking is often provided for. Touching without a question is not. KitKatClub in Berlin writes on its site that it is not a swinger club, and that touching without consent means a lifetime ban. visitBerlin repeats the consent line and the photo ban. That is operator copy and tourism copy, not a promise for every fetish door in the country.

In the studio you are the other person in the room. A session is time-limited: a talk beforehand, a safeword, aftercare. You are not in the audience. If you wanted only to watch, you booked the wrong format.

Latex at the door, a cross in the diary

Fetish fashion (latex, leather, PVC) is club language. The outfit often decides whether you get in. It is not an invitation to be touched, and it is not a negotiated scene.

A studio hour is built around equipment and a plan: a cross, a bench, a clinic room, whatever the listing names. Intercourse is often not the centre of SM parties. Many studios exclude it in their booking text. That is an operator line. It is not a legal exception.

Hybrids: same house, different contract

Some houses refuse to stay in one column. Insomnia in Berlin is listed here under fetish clubs and sells itself as a nightlife and swinger club with fetish and BDSM nights. Club de Sade in Hamburg sells play parties with a leather and latex code, and writes that a dominatrix can be booked on top. TOUCH in Hamburg calls itself a BDSM nightclub and writes that there is no dress code, and that erotic contact is wanted but not required.

That is operator copy. It means the category in the directory is a shelf, not a verdict. The house rules of that evening decide. If a session is extra, you bought two things.

What the law looks at

A sexual service is a sexual act by at least one person on or in front of at least one other person present, for payment, or allowing such an act on or in front of one’s own person for payment.

Prostitutes Protection Act, section 2

Intercourse is not in that sentence. A performance with a purely theatrical character, where nobody else is sexually involved, is excluded. A spiritual, educational or “no intercourse” label is not.

The Berlin Administrative Court, on 22 July 2020 (14 L 163/20), treated a BDSM and dominatrix studio as a prostitution establishment. The services were BDSM without intercourse. The Baden-Württemberg Higher Administrative Court, on 20 August 2020 (1 S 2347/20), treated a dominatrix studio the same way in a pandemic closing case. Two emergency decisions, not a statute that names every house in the country.

A fetish club night is not automatically a prostitution event. The statute needs an open audience and at least one person present offering a paid sexual service. A cover charge alone does not do that. If sex work happens with the operator’s knowledge, the label on the flyer does not save the evening. North Rhine-Westphalia’s trade guidance says the same about clubs that call themselves swinger clubs.

The condom rule in section 32 applies to intercourse with a prostitute, and the operator of a prostitution business must post it. It does not attach itself to the word fetish on a door.

The third door, and what does not belong

A swinger club puts sexual encounter among guests closer to the centre than rope or a latex code. A kinky party is a door sign for a night, not a building type. A sex shop is retail. None of the three is a booked studio hour.

What to settle before the door

  • Is it an event or an appointment?
  • Are you paying the house, or a person?
  • Is there a play area, and is sex provided for there?
  • Is the dress code required, a suggestion, or open?
  • Phones and photos: banned, or only away from the play space?
  • Who do you go to if a line is crossed?
  • Does the booking text include intercourse, or rule it out?

Prices differ by house and by night. There is no national rate here. The number that counts is on the event page or in the booking mail.
