Escort or brothel?

If you put escort and brothel in the same search, you usually want a door decision: a person on an appointment, or a house you walk into. The words overlap in the ads. The law splits them.

A brothel, a laufhaus and a sauna club are already explained on this site as houses. This piece does not retell those floor plans. It sets escort against the house.

House or person

A prostitution establishment is buildings, rooms and other fixed premises used as a place of business for sexual services. That is the house: you go there. A laufhaus is corridors. A sauna club is a day ticket, then a person. The name on the door does not change the walk-in.

Prostitution mediation is arranging at least one other person to provide sexual services outside the operator’s own establishments. The government bill names an escort service as the example. Typical picture: an evening of company that includes sexual contact, or work as a call girl or call boy in a hotel or the customer’s flat. Sex does not have to be fixed in advance. The test is whether customers may assume it is part of the picture.

Solo work without an agency is still sex work. It is not automatically a mediation business. The Act needs at least one other person being placed.

Two places, two tills

In the house you pay the door, or you do not, and then you pay a person. In escort you book a person, then you meet in a hotel, a flat, or somewhere else. Sometimes there is an agency fee on top. There is no national rate here for either till.

The Federal Statistical Office, at the end of 2025, counted about 2,260 valid licences for prostitution businesses. 93 percent were establishments, “for example brothels”. 5 percent were mediations. That is licences, not heads, and it leaves out anyone who did not register.

Companionship does not rewrite the statute

Wikipedia notes that escort agencies often claim they only offer a house or hotel visit and company, unlike a brothel, a club or a laufhaus. The ministry says mediation still applies when it is not yet clear whether sexual acts will be part of an escort service. Girlfriend experience is trade slang for staged closeness. It is not a legal category.

A Spiegel interview with an escort agent, in 2016, put it this way: sex is not necessarily part of the deal in advance, “we are not a brothel after all.” That is one voice, dated. It is not the statute.

When escort becomes a house again

If the agency itself provides the rooms, a model flat, an incall apartment, the booking can be an establishment. North Rhine-Westphalia’s advice portal writes that working alone in your own flat is not an extra operator licence. Sharing a flat with others can make that flat an establishment. The individual case decides. The word escort on the profile does not.

What the law looks at

Prostitution mediation is the arranging of at least one other person to provide sexual services outside prostitution establishments of the operator. This also applies if it is only apparent from the circumstances that the services arranged include sexual acts.

Prostitutes Protection Act, section 2(7)

The restricted right to give instructions applies to a house and to an agency. Nobody may prescribe whether, how or to what extent sexual services are provided. That is settled between the person and the customer. There is no claim on sex because you booked.

The condom rule applies in every format. Customers and prostitutes must use condoms during intercourse. Hamburg names oral, vaginal and anal. Fines hit the customer, up to 50,000 euros. A house must post the rule and keep condoms available. A hotel room typically has no poster on the minibar. The duty remains.

An agency is not automatically pimping. Section 181a of the Criminal Code needs exploitation, control of place, time or extent, or commercial placing that harms personal or economic independence. Licensed mediation is a trade. Whether the crime is met depends on the power in that relationship, not on the word escort.

What to settle before you pay

• Are you walking into a house, or booking a person?
• Hotel, flat, or the operator’s own rooms?
• Who do you pay: the person, an agency, the door?
• Does the copy say companionship only, and do the circumstances still point to sex?
• Condoms: posted in the house, or only your duty as a customer?
• Can the person refuse or stop, without the house or the agency deciding the act?

Prices differ by house, city and booking. There is no national rate here. The number that counts is in the booking, not in a search snippet.

In short: escort sells a person on an appointment, usually outside the operator’s house. A brothel sells a house you walk into. If the agency provides the room, you are back in a house. The law looks at establishment versus mediation, not at the word on the profile.
